FREQUENTLY ASKED QUESTIONS
Q: Where does the court case against the owner stand?
A: The court case is still ongoing, and the judge has scheduled the next hearing for August 22. The building is still condemned as all of the life safety issues have not been adequately addressed. The latest inspections took place on Friday, July 29, and the elevators failed. Other life safety issues are still outstanding, including the fire alarm panel and the water heater boiler.
Q: Why did the city condemn the building?
A: The city of Newport News has been working since April to try to get the owner to make repairs to the elevators so that they are both operating properly with the required safety features in place in order to meet city code and pass inspections. Several court’s orders have been issued mandating the owner make repairs to the elevators as well as address other life safety issues, including the fire alarm system and boiler. The owner failed to comply with the court’s orders and the judge ordered the building condemned.
Q: What's the status of the building?
A: The building is still condemned as all of the life safety issues have not been adequately addressed.
Q: When can we move back in?
A: The building is currently not safe for occupancy. The owner must adequately and properly address the life safety issues before the condemnation can be lifted and residents can move back in. Unfortunately, the city does not know when that will be.
Q: Can I break my lease with SeaView Lofts?
A: We have been advised that Seaview Lofts tenants who break their lease won’t be penalized, but it is in your best interest to reach out to the property manager to confirm that before breaking your lease.
Q: Can I go in and get items from my apartment?
A: Yes, residents can make arrangements with the property manager to go in to their apartment to retrieve items. Please contact the property manager at (757) 999-9649 or send an email to seaviewlofts@bluerisegroup.com
Q: Will the City cover fees associated with moving? (security deposit, first/last month rent, movers...etc.)
A: No, the City will not be providing direct monetary support for moving assistance; however, we do plan to connect SeaView residents with community resources that may be of aid should they decide to relocate.
Q: What legal resources are available to me?
A: Consumer Litigation Associates - 757-699-5211 - clalegal.com
Legal Aid Society of Eastern Virginia - 757-827-5078 - laseva.org
Q: Are gift cards being provided to all SeaView leaseholders?
A: Newport News Clergy have secured gift cards for Seaview leaseholders. One gift card per unit was provided to SeaView Lofts leaseholders. If you have not received a gift card for your unit, email safe@nnva.gov.
Q: Will I be reimbursed if I am paying out of pocket for my hotel stay?
A: There are provisions in the Landlord and Tenant Act that allow for SeaView tenants to be reimbursed by the landlord in situations like this. Tenants can contact Legal Aid at 757-827-5078 or Consumer Litigation Associates at 757-699-5211 to seek guidance or they file on their own in General District Court.
